Orange County, CA – A federal judge decided yesterday that the protections that DACA grants undocumented youth must remain in place until litigation challenging the program proceeds.
In his ruling, U.S. District Judge William Alsup of San Francisco says that the rescission of DACA “was arbitrary, capricious, an abuse of discretion, and otherwise not in accordance with law.”
While this news is celebratory for many in the undocumented community who may be able to renew permits that expire in the next six months, it must be taken with caution.
The National Immigration Law Center recommends that folks hold off on submitting a DACA renewal application until USCIS announces a process.
An appeals court could quickly overturn Judge Alsup’s ruling and allow for the shutdown of DACA.
